The purpose of this document is to establish the Terms and Conditions (“Term“) of Use applicable to the website (“website“) https://porno.spartanas.com.

The Term was originally written in Brazilian Portuguese (PT-BR). If this Term is offered in any language other than PT-BR it shall be for information purposes only and, in the event of a conflict between the PT-BR language version and the translated language version, the PT-BR version shall prevail.

Please read the terms carefully before accessing the website, as it is important that you (“User“) know what to expect when using the website services and what W2M COMERCIO E PUBLICIDADE DIGITAL LTDA. (“SPARTANAS“) expects from the User.

Please review the Terms of Use carefully before using it. If you do not accept these terms and conditions, you may not use our services.

By accessing the website, you accept this Term and acceptance by the User generates a contractual relationship with SPARTANAS. You acknowledge that you are and will always be free to use the services or not.

These Terms are subject to change at any time. Changes are effective when posted on the website, and may be without prior notice. The most up-to-date Term (last published) prevails.

All transactions are SSL encrypted.

It is very important that you read everything carefully.

To access the paid content of the website, such as movies, you must first register.

Simply access the “Login” option on the website’s home page and enter a valid e-mail address in the “Register” field. After registering, the User will receive a link to define a password to access the website, as well as providing your full name.

You declare and undertake to provide truthful and up-to-date data in your registration, being liable, in any case, civilly and criminally, for the truthfulness, accuracy and authenticity of the Personal Data registered.

SPARTANAS may request additional data, as well as copies of documents to verify the veracity, accuracy and authenticity of the Personal Data.

SPARTANAS reserves the right to refuse any registration request and to suspend a previously accepted registration that is or will be in disagreement with the policies and rules of these Terms and Conditions of Use.

SPARTANAS, due to violations of current legislation or the Terms and Conditions of Use, depending on the situation, may, without prejudice to other measures, refuse any registration request, warn, suspend, temporarily or permanently, a User’s account.

The User will access their account via e-mail (login) and password and undertakes not to disclose these details to third parties, taking full responsibility for any use made of them. You may not authorize third parties to use your Account, nor provide your login to minors under the age of 18. You may not assign or otherwise transfer your Account to any other person or entity.

SPARTANAS, nor any of its employees or agents, will request, by any means, physical or electronic, that you provide your password.

It is the User’s responsibility to: (a) keep their account identification and password confidential; (b) update and review their account frequently; (c) keep their electronic devices secure, for example, by using antivirus and firewall tools; and (d) promptly notify SPARTANAS in the event of any unauthorized use of their account or any breach of security.

You are responsible for all activities carried out through your account and SPARTANAS will not be liable for any loss or damage arising from your failure to comply with your obligations hereunder.

Simultaneous access on different devices by the same User will block use and may result in termination of the contract for just cause and consequent cancellation of the subscription.

If you do not want to register and pay for a subscription, you will only have access to the “calls” of paid content, as well as links to external content on the site.

When you log in to the website, you will have access to our available subscription plans, at which point you can choose the one that best suits your profile.

After choosing the best subscription plan, you will be directed to the checkout page, where you can make your purchase via Pix, Boleto, Debit Card or Credit Card. Users from outside Brazil will only be able to purchase by credit card.

Once payment has been made, the purchase of the chosen plan will appear on your credit card bill/statement as S2P*W2M or will appear as SAFE2PAY for PIX.

Taxes such as VAT, financial transactions tax, sales tax and others may be included, or added, to your purchase depending on your country, state, territory, city and other locations with applicable regulations. Tax rates may vary accordingly.

Payment transactions are processed by SAFE2PAY and SPARTANAS has no responsibility for the transaction, nor does it store any data requested at the time of payment.

If the User chooses to pay for the purchase via bank slip and fails to pay the slip by the due date, the order will be automatically canceled.

The website currently has 5 (five) different types of access, as follows:

3.1. RECURRING SUBSCRIPTION: access for 30 days automatically renewed. (Only available in Brazil)

The Recurring Subscription means that it is an ongoing service and will only be stopped if you cancel the subscription. Therefore, while the subscription is active, you will have access to the content for the contracted period and the subscription will be automatically renewed for the same period (monthly). Recurring subscriptions can only be purchased by credit card.

Your subscription will be interrupted if you:

3.1.1 Click CANCEL on your Recurring Subscription, your access will be blocked immediately. To stop the recurring cycle, you must cancel your subscription the day before the billing date indicated in the Recurring Subscription tab of your Account.

3.1.2 Or if your credit card is rejected due to a problem with the financial operator or insufficient balance. In this case, your status will stay as non-compliant until the next successful charge (consecutive month), or you can contact directly with the site by e-mail, to reactivate your access through a manual charge by bank ticket or pix.

The Recurring Subscription Plan

To access the recurring subscription, simply go to the “Recurring Subscription” field in “My Account”.

3.2 SUBSCRIPTION PLANS:

You can contract one of the subscription plans below:

• Athena 30: access for 30 days;
• Aphrodite 90: access for 90 days;
• Gaia 180: access for 180 days (only available in Brazil); and
• Hera 365: access for 365 days.

Once you have purchased an access plan, you will have access to the content for the specific period of the chosen plan.

Once the period of the contracted plan has expired, in order to continue accessing the content, you will need to purchase a new plan. Plan renewals are not automatic, unlike recurring subscriptions.

Please note that canceling any plan without contacting Spartanas directly via e-mail [email protected] does not mean that your purchase price will be refunded, but rather that your access to our streaming will be canceled.

To access your contracted plans, simply go to the “Orders” field in “My Account”.

The purchase operation on the platform works through the payment of products by the User directly to SPARTANAS, via partner Payment Means companies.

The linking of the payment method, as well as the processing of transactions – whether by debit card, credit card, pix or bank ticket – is subject to the provisions set out in the Terms and Conditions of Use and Privacy Policy of the Payment Means Companies responsible for the payment transaction, as well as the security conditions and anti-fraud mechanisms of the User’s card Issuing Bank, without any interference from SPARTANAS.

Subscribing users will receive the purchase receipt for the contracted plan in their registered email address. Subsequent transaction updates may be communicated to the subscriber via the members area (My Account) in this website when logging in to secure the receipt in the event that the subscriber unsubscribes from email communications.

The subscriber may request from Spartanas and/or Safe2Pay a copy of the purchase record on this website, but neither Spartanas nor Safe2Pay can guarantee the availability of such record after 365 days from the purchase date.

If, for any reason, a payment made by the User through the website is not authorized by the Payment Means Company responsible for capturing, processing and settling financial transactions, or by the Issuing Bank of his/her credit card, the transaction may be interrupted and the User must find another means of payment.

In the event of the above occurring, regardless of the reason, the User will not be entitled to receive any refund or compensation.SPARTANAS does not store any data linked to payments and therefore has no responsibility for such transactions.

By purchasing a subscription, the User agrees that Spartanas has no legal obligation to reimburse them, unless proven by local regulations, such as those of Brazil, in which case the regulation will only apply to the User who lives in areas covered by it.

Under the terms of article 49 of the Consumer Defense Code (CDC) issued by the National Consumer Secretariat of Brazil, the User may withdraw from the purchase and obtain a refund within 7 (seven) calendar days after accessing the product, in this case the subscription plan, if the User is in Brazil. After the seven (7) calendar days following access to the product there is no legal obligation to refund.

All refunds are made without admission of liability and may be subject to the support of your payment method. In the event of a refund issued by Safe2Pay for any reason, it will only be credited to the payment method used in the original transaction.

If you wish to withdraw from the purchase, please contact us at [email protected] to request cancellation of a purchase and refund of the amount paid.

The amount paid by the User will be refunded according to the payment option chosen:

For credit card, the card operator will be notified of the cancellation of the debit within 7 (seven) working days. If the charge has already been made, the paid installment(s) can be reversed within 2 subsequent invoices, this procedure being the responsibility of the financial institution. Please note that, in this case, the installments will continue to be charged until the reversal is made and the rest of the amount is cancelled.

For purchases made by pix, the bank details (bank, checking account, CPF and pix key) must be provided by the User when sending the withdrawal e-mail. The amount will be deposited in the account holder’s checking account within 7 (seven) working days. If the owner of the purchase does not have a checking account, they will need to send (registered letter or e-mail) a signed letter with identification of their RG, CPF, SSN or another government-issued identification number with full details of the credit authorization. Important: please provide your bank details carefully, including the account digit, to avoid delays in the reimbursement process.

If a refund is requested, SPARTANAS reserves the right to request a copy of the User’s identity document to verify legitimacy.

All materials displayed or made available on the website, including, without limitation, text, graphics, sounds and audio, documents, videos, artwork, software, logos and HTML code (collectively, the “Material”) are the exclusive property of SPARTANAS, which reserves all of its intellectual property rights. The Materials are protected by copyright, intellectual property and other applicable Brazilian, U.S. and international intellectual property laws, rules and regulations.

SPARTANAS grants you a limited, non-sublicensable, non-exclusive, revocable and inalienable license that allows: (i) access to and use of the Site on the User’s personal device solely in connection with the User’s use of the services; and (ii) access to and use of any content, information or related materials that may be made available through the services, always solely for personal (as a consumer) and non-commercial use.

The total or partial reproduction of any content without the prior authorization of SPARTANAS is expressly prohibited. It is expressly forbidden for the User to make a copy of the videos made available on the website, as well as it is forbidden for the User to record the screen in order to unduly reproduce content protected by copyright.

Any trademarks, service marks and logos (the “Marks”) displayed on the website are the exclusive property of their respective owners. You may not use the Marks in any way without the prior written consent of their respective owners.

In the event that these terms are breached, the subscriber must immediately destroy any information or material reproduced, downloaded or otherwise copied from this website.

The User’s obligations, among others provided for herein, include:

I – To be over 18 (eighteen) years of age;

II – Provide true and complete information during the registration process, keeping it up to date at all times;

III – Ensure the security and confidentiality of your login and password, which are personal and non-transferable, and you are solely and exclusively responsible for their use and safekeeping, assuming all the burdens and responsibilities arising from your actions and conduct, as well as being liable for the actions of third parties on your behalf, through the use of your login and password;IV – Not violate intellectual property rights of SPARTANAS or third parties;

V – Not incorporate malware (malicious computer code or program that may cause damage, alteration or theft of information), not allowed the use of any device, software or other resource that may interfere with the activities and operations of SPARTANAS, as well as accounts or databases, is not permitted. Any intrusion, attempt or activity that violates or contravenes the laws of intellectual property rights and/or the prohibitions stipulated in these Terms and Conditions of Use, will make the person responsible liable to the relevant legal actions, as well as the sanctions provided for herein, and will also be responsible for compensation for any damage caused;

VI – Not to use the website for illegal activities, such as threats, child pornography, violence, etc;

VII – Not to use the website for spamming;

VIII – To answer for irregular or illicit acts practiced on the website;

IX – Not exploit errors in design and resources that are not documented, and/or bugs that may grant access that, if they did not exist, should not be granted;

X – Not attack the website by means of a denial-of-service (DOS) attack or a distributed denial-of-service (DDOS) attack;

XI – Not insult actors/actresses or other users through comments; offenses against, but not limited to, ethnicity, appearance, sexuality and religion are prohibited.

If it becomes apparent that the User is not complying with their obligations, your purchase will be canceled and a refund may be issued to you discreetly. We also reserve the right at our sole and final discretion to prevent you from entering this website, such as, but not limited to, closing your account.

The following are obligations of SPARTANAS, among others provided for herein:

I – Provide Users with access to the Restricted Area within 24 (twenty-four) hours of confirmation of payment, by providing a login and password;

II – Provide all the necessary information and tools from the website so that the User, after contracting the subscription plan, can access the available content;

III – Provide notices via this website to the User via this website, via publications on this website or via conventional email.

SPARTANAS shall not be liable for any damages arising from the total or partial unavailability of the website, as a result of:

I – Technical and/or operational maintenance;

II – Interruption or suspension of services provided by companies offering Internet access;

III – Fortuitous event or events of force majeure, including but not limited to power outages, malware attacks and actions by third parties that prevent its availability and/or integrity, for example: removal of the website from the air, improper alteration of content;

SPARTANAS is not responsible:

I – for acts of bad faith by third parties, such as hackers, who access the User’s registration and personal data and unlawfully use them for any purpose;

II – by the loss of information and data sent by the User via the website or other means;

III – by the means of payment chosen by the User.

IV – for operations carried out by third parties that link to Spartanas or other sites that Spartanas has linked to, nor for conversations and information carried out between Users and actors/actresses on other sites.

You are responsible for obtaining access to the data network necessary to use the Services, and you are responsible for acquiring and updating compatible hardware or devices necessary to use the website and any updates thereto.

SPARTANAS only guarantees that the Services, or any part of them, will work on a specific piece of hardware or device if there is the necessary compatibility. In addition, the Services may suffer from malfunctions or delays inherent in the use of the Internet and electronic communications.

To keep you informed about your account, products and services of SPARTANAS, as well as security information, we may send you e-mail.

SPARTANAS will spare no effort to resolve any problem that you, the User, may have on our platform.

However, if there is no amicable, out-of-court solution, you agree that the competent court to settle any dispute relating to these Terms of Use or the Privacy Policy, to the exclusion of any other, will be the District of Mogi das Cruzes/SP (Brazil).
